Courses provided by California CPR are optional and provided in good faith. By enrolling and participating in any of our courses, the participant, also known as "student", agree to the terms as below. The student has a right to disagree to the terms below by NOT enrolling and NOT participating in our courses. In exchange for participation in the activity of obtaining courses organized by California CPR and or use of the property, facilities, affiliate facilities and services, the student agrees to release and forever discharges the course provider, affiliates, employees, providers spouse, executors, administrators, legal representatives, and assigns from all manner of actions, causes of actions, debts, contracts, malpractice, negligent, reckless claims and demands for or by any reason of any injury including and resulting in the death of the participant, affiliates or recipients including patients, and bystanders.
- In order to obtain any CPR certification, course requirements must be fulfilled in accordance with the American Heart Association guidelines including: course fees, completing the desired course in its entirety, and objectively obtaining a pass score for the written and skills exam and agree to the the cancellation, refund and rescheduling policies. We reserve the right to deny service.
- Agreement to course content: By accepting a certification card, the student agrees to act in good faith as best as possible as protected by the Good Samaritan Law and follow course guidelines as best as possible should CPR be performed live on a human.
- Agreement to Follow Directions: It is the students responsibility to be familiar with the facilities/place of employments rules and policies regarding CPR, as well as DO NOT RESUSCITATE (DNR) policies, and will not hold California CPR and affiliates liable for any negligent, reckless acts or malpractice acts on their behalf.
- Assumption of the Risks and Release: There are inherent risks associated with taking a CPR course by the nature of the physical activity that it may entail such as physically giving compressions to manikins. The student assumes full responsibility for personal injury to themselves and further release and discharge California CPR and affiliates for injury, loss, or damage arising from the use of or presence upon the facilities of California CPR or remote/mobile locations
- Fees: Should any damages to the facilities or equipment of California CPR be caused by any negligent, reckless, or willful actions, and or counterparts the student agrees to the financial responsibility of such damages.
- Dispute Resolution: Shall a dispute arises, the parties will attempt to resolve any dispute through friendly negotiations amongst parties. If the matter is not resolved by negotiation, the parties will resolve the dispute via mediation in accordance with any statutory rules of mediation. If mediation does not successfully resolve the dispute, then the parties may proceed to seek an alternative form of resolution in accordance with any other rights and remedies afforded to them by law.
- Communications: Telephone services are recorded for quality assurance. Video surveillance of public common areas including the parking lot, foyer, hallways and classroom are actively on non discreet, physically visible and monitored by property management security with the sole purposes of quality assurance.
